Free Trade opportunity

 Free Trade Negotiation in the MAPA. In an appropriate procedure the contracting authority shall indicate the use of negotiation in the notice advertising the consultation documents.
 

The possibility of negotiation is a main feature of the appropriate procedure accordingly and in order to ensure transparency of procedures, the contracting authority must state the opportunity to negotiate once the notice of advertising is in the consultation documents.

Based on Article 28 of the procurement code (CMP) on the appropriate procedures as well as Article 42 of the Public Procurement Code  relating to the settlement of the consultation, Senator, the question arises whether the use of negotiation must be specified among the main features of the procedure.

The response of the Ministry of Economy, Industry and Employment is: If the buyer wants to negotiate as part of an appropriate procedure for the sake of transparency of the procedure the contracting authority must mention the use of negotiation in the notice advertising the consultation documents.
